General Terms

These Terms and Conditions govern the use of all internet, hosting, telecommunications, managed services, and related products supplied by Wennze trading as NDIO ("NDIO", "we", "our", or "us"). By applying for or using any NDIO service, you agree to comply with these terms together with any product-specific conditions, policies, or procedures communicated by NDIO.

These terms apply to the account holder and any person using services linked to the account. The account holder remains responsible for all activity, usage, and payments associated with the account. Where applicable, the provisions of the Consumer Protection Act and other South African legislation shall apply and prevail over conflicting clauses.

Acceptable Use Policy

Responsible Use

Customers are expected to use NDIO services responsibly, legally, and respectfully toward other users and networks. Services may only be used for lawful purposes and in a manner that does not interfere with network performance, security, or stability.

Prohibited Activities

  • Illegal activities or unlawful content distribution
  • Copyright infringement or unauthorized software distribution
  • Fraudulent activity or identity misrepresentation
  • Hosting malicious software, phishing systems, or hacking tools
  • Sending spam or bulk unsolicited communications
  • Running torrent services, open proxies, or abusive automated systems
  • Network abuse, denial-of-service attacks, or excessive server usage
  • Publishing defamatory, abusive, or harmful material
  • Violating intellectual property rights

NDIO may suspend or terminate services immediately where prohibited activities are identified.

Network & System Security

Customers may not attempt to gain unauthorized access to systems, probe security vulnerabilities without authorization, interfere with network performance, forge headers or identities, or use excessive resources that negatively impact shared infrastructure.

Spam Policy

The use of NDIO systems for unsolicited messaging or mass email campaigns is prohibited. Any spam-related complaints may result in investigation, suspension, cleanup fees, or account termination.

Investigation & Enforcement

NDIO reserves the sole right to determine whether activity violates these Terms. Where a breach is suspected, NDIO may investigate, restrict or suspend services, remove harmful content, report unlawful activity to authorities, and recover costs related to investigations or damages.

Service Availability & Hosting Usage

Shared hosting and shared infrastructure services are intended for normal personal or small business usage. NDIO may modify pricing, specifications, limits, features, or service offerings from time to time with reasonable notice where required.

Customer Responsibilities

Customers are responsible for maintaining the confidentiality of passwords and account credentials. Customers remain fully responsible for all websites, content, communications, and data hosted or transmitted using NDIO services.

Billing & Payments

Invoices are issued electronically. Payment is due by the invoice due date. Failure to make payment may result in suspension, restriction, or cancellation of services. NDIO may accept payment through debit order, EFT, card payments, or approved electronic payment platforms.

Refunds will only be processed where an account reflects a verified credit balance or where required by applicable law. Setup fees, installation fees, domain registrations, and third-party supplier costs may be non-refundable.

Cancellations

Cancellation requests must be submitted through official NDIO communication channels or customer portals. Unless otherwise stated, one calendar month notice may be required. Certain fibre providers or infrastructure partners may impose cancellation or clawback fees, which remain payable by the customer where applicable.

Limitation of Liability

NDIO provides services on an "as available" and "as is" basis. NDIO shall not be liable for service interruptions, data loss, delays or failures caused by third parties, network outages, security breaches beyond reasonable control, or indirect or consequential damages. Customers are encouraged to maintain independent backups of important data.

IP Addresses & Network Allocation

Any IP addresses assigned by NDIO remain the property of NDIO or its upstream providers. Certain services may make use of CGNAT or shared addressing technologies. Static IP options may be available on selected services at additional cost.

Dispute Resolution

Customers are encouraged to first raise complaints directly with NDIO support channels. Where disputes cannot be resolved internally, customers may escalate matters through the appropriate South African regulatory or legal channels, including ICASA where applicable.

General Legal Terms

These Terms constitute the full agreement between NDIO and the customer regarding supplied services. NDIO reserves the right to update or amend these Terms periodically. Continued use of NDIO services after changes become effective constitutes acceptance of the revised Terms. These Terms shall be governed by the laws of the Republic of South Africa.
